Compulsory Purchase Orders
A Compulsory Purchase Order (CPO) is a method by which the Government or public bodies including local authorities can purchase land for the benefit of the general public. A CPO can be made by Shetland Islands Council (“the Council”) to purchase of a piece of land that is in the interest of the public where it has not been able to reach an agreement with the landowner, or where the landowner has failed to comply with a listed building repair notice. Relevant legislation. A CPO will only be used as a necessity.
Right to Object
Anyone has the right to object to the Order during the objection period. This period runs for at least 21 days from the date notice of the CPO is first published in a local newspaper. Any objection must be made in writing (by letter or email) directly to the Scottish Government.
If the CPO is confirmed by the Scottish Ministers, after considering any objections, a Notice of the confirmation order will be published in a local newspaper. From there, any party with interest in the property may apply for compensation in respect of their interest.
