According to council documents, the SIC has sold 1100ha of land since 2021.
Please you provide a list of those land sales, including for each sale: the date of sale, the area of the land and its location, the area of peat bog within the parcel sold (as determined using Corine land cover data, or otherwise) and whether the land was bought by its existing tenant exercising right to buy or sold voluntarily.
Thank you for your email to clarify all crofting tenants purchases were through the "Right to Buy".
I am unable to give an accurate measurement of peatbog within the areas of land sold as in many cases the crofter was purchasing their inby and apportionment land together so we do not hold this information.

To answer about the peat bog we don’t hold this information. Discussions were held at a recent council meeting where reference was made to the inclusion of land in the emissions data, and to the emissions reduction being due to land being sold and clarity was sought on the reasons for the land being sold. It was advised that exclusively crofting tenants had been exercising their right to buy land. It was suggested that further work could be done to understand whether there had been a surge or a gradual process for tenants to choose to become owner occupiers.

I request some information about the museum store that is currently held in Staney Hill, but which is being relocated.
1) Is there an inventory of what is kept in the store? If so, could I please receive a digital copy of it?
At present the inventory of all museum items is held in a system and format that cannot be extracted or published. In this regard we are unable to provide you with a copy of the inventory, as it would require the Council to create a manual system to extract data, analyse the data for items held in different locations or with different ownership, disclosure and property rights, then to put it into a separate inventory for the store, and in a reportable format. In this regard, the information you have sought is information not held under Section 17 of FOISA.
To assist, the Shetland Amenity Trust (SAT) website has a general description of all items held, and you can contact the SAT if you are looking for anything in particular Museum Collections | Shetland Museum & Archives. Regarding the Staney Hill store particularly, a general description, as reported in the press, is that there are approximately 185,000 items, ranging from archaeological artefacts to old clothes. The Museum’s Collections Policy was also considered by the Council in November 2023, and can be viewed on our website here https://coins.shetland.gov.uk/submissiondocuments.asp?submissionid=29650.
Information is recorded in the minute about the capacity issues and the fact that 98% of the collection was held in the store at that time, which has not been verified as still being the case, and there is recorded information in the policy about the type of artefacts held.
2) I understand an options appraisal was carried out into where the store could be relocated. Would it be possible to receive a copy of the options appraisal?
The process of an options appraisal is ongoing and no final options appraisal has been published, as no decision has yet been sought or taken on possible relocation sites. In this regard, the information you have sought is information not held under Section 17 of FOISA.

Therefore having considered the time that it would take for staff to locate and provide the information you have requested, it is considered that this would be over the statutory threshold of £600. Given the current workload of those staff, it would be impractical for the Council to spend time in providing you with the level of detail you have asked for, and to do so would not be the best use of the Council’s resources.

I have to advise that this pertains to information that is exempt from disclosure and will not be released by the Council, for the following reasons under the Freedom of Information (Scotland) Act 2002:
Section 30(b)- free and frank provision of advice or exchange of views
This exemption applies because disclosure would, or would be likely to, inhibit substantially the free and frank exchange of views for the purposes of deliberation. This exemption recognises the need for Councillors to discuss and explore options and advice before the Council reaches a settled public view, and because these discussions are still ongoing and decisions have not been taken.
Section 33: Commercial interests and the economy
An exemption under 33(1)(b) of FOISA (Commercial Interests) applies to all of the information requested as disclosure would (or would be likely to) prejudice substantially the commercial interests of any person or organisation (section 33(1)(b)), namely the Council and any organisations or persons who submitted responses.
These exemptions are subject to the ‘public interest test’. Therefore, taking account of all the circumstances, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption. We recognise that there is a public interest in disclosing information as part of open, transparent and accountable local government, and to inform public debate. However, there is a greater public interest in allowing Councillors and their advisers a private space within which to explore options and advice, and if necessary to refine the Council’s position on the issues to which this advice relates. This private thinking space is essential to enable all options to be properly considered, so that good decisions can be taken. Premature disclosure is likely to undermine the full and frank discussion of issues between Council, officials and its advisers, as well as any third parties who are engaging in negotiation or legal processes with the Council, and which in turn will undermine the quality of the decision making process, which would not be in the public interest.
Section 36(2) – Actionable breach of confidence
An exemption under section 36(2) of FOISA (actionable breach of confidence) applies to all of the remaining information requested and disclosure would constitute an actionable breach of confidence. This is because the information in relation to any submitted bids is confidential and provided in circumstances which impose an obligation on the Council to maintain that confidentiality. Unauthorised disclosure would be to the detriment of the organisation or person who provided information, and to the Council.
This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.

I would like to make an FOI request for all payments made to suppliers/consultants who provided quantity surveying services to Shetland Islands Council from April 2018 to April 2024. As a minimum, please include the date, value, recipient of each payment, the project/works which each payment relates to, the SIC department making the payment, and how the services were procured.
I can advise you in terms of Section 17 of the Freedom of Information (Scotland) Act 2002 [FOISA], this is not recorded information held by the Shetland Islands Council and to provide that information would exceed £600, which means that the Council does not have to carry out the work required to extract the information requested from records held.
To explain, from April 2018 to April 2024 (6 years) there were payments made by Shetland Islands Council which will have included an element of quantity surveying services. These payments range across many different projects, some of which may clearly identify the provision of quantity surveying services and others where the provision of that service may not be clear and contained within a wider description of the works carried out on behalf of the Council required. To provide you with figures that relate only to the payments made for quantity surveying services would require a manual check of individual contracts and invoices paid over the period requested. To do that manual check would exceed 40 hours and therefore cost in excess of £600.

When was the construction of the science block completed?
The Science Block was completed in 1995. It was designed as a temporary building with a limited life as the AHS was due to be replaced. This useful life was for 20-25 years. By today’s standards it has an inefficient EPC value and therefore had high running costs throughout its lifetime. The building has electric heating and is not connected to the district heating scheme.
What was the gross construction cost at that time?
The value of the work as noted on the Building Warrant (BW/1991/8889) was £1,088,000.
What is the internal floor area of the building?
The building is basically two portal frames, each covering 300sqm and joined by a central atrium. The overall floor area is around 700sqm
Did SIC use an external Chartered Surveyor to determine valuation at £40000?
No.
If this is not the case, does SIC now consider it appropriate to have an external Chartered Surveyor determine market valuation.?
No. All valuations on the property portfolio are undertaken in house by a fully qualified and registered RICS Valuer and are then subject to Audit by the Council’s external auditors and valuers every year.
I raise this query because the described valuation the science block appears to me to be exceptionally low. For comparison, a small serviced plot for a modest house in Lerwick would exceed £50,000.
It should be noted that there are many factors considered when determining the value of a property, which will impact on the final figure. The building was considered at the end of its useful life and would require considerable investment to comply with current legislation if to remain occupied. Alternatively, there would also be significant costs associated with demolishing the property. Your point of the site value seeming low, if related directly to other vacant and cleared sites in the town, is valid. However, as already mentioned the site is not cleared and development opportunity is limited by the Listing of the Janet Courtney along with other factors such as servicing and the topography of the site.

The Orkney and Shetland Valuation Joint Board do not generally provide this service. The property was valued as part of the Asset Register rolling programme of valuations in 2020 to the standards set by the RICS and CIPFA.

Could you please confirm if the council has any plans to rewild any council-owned lands? We are currently working on our Shetland Net Zero Route Map and our SIC Net Zero Route Map. Within this works we are looking at Land Use Land Use Change and Forestry. We are also undertaking a carbon sequestration and land management assessment. The outcome of this will be a route map with a programme of works and a GHG emissions pathway modelling tool. This will allow us to plan and undertake the most effective projects/initiatives to increase biodiversity and carbon sequestration.
Can you give details of these upcoming plans? Plans and projects will be outlined as part of the Net Zero Route Map projects.
